🚨UPDATE! 🚨 We're starting the week off with some good news regarding our legal case! Apologies in advance for the lengthy post. . . . You may remember that over a year ago Francesca's, Express, OK Originals, and Orion Fashions began selling copies of artists' pins, including our Banana Split Sundae pin. The companies tried to hide the infringements to save face and refused to take any responsibility for their actions, so we banded together with the other artists to take legal action. The infringers then tried to get the court to dismiss our case and strip us of our creative rights to our own work. They even stated that the artwork they copied from us was "basic, unoriginal" and "lacked creativity." However, these giant retailers systematically copied independent artists's designs and violated the DMCA by intentionally stripping designs of their owners' copyrights. The infringers' move to dismiss majorly backfired for them, as the judge ruled against the infringing companies on every point that matters and is allowing the case to move forward. 🎉 This decision is a huge win for artists! It clarifies another way that the DMCA can help fight infringers and creates a roadmap for artists to follow in the future when their work is stolen by "basic" and "unoriginal" corporate retailers like ours was. Also, it is now on record that this case is against "known infringer" / "known distributors of knockoff and copycat goods," as the judge affirmed this language. 💖 We want to thank everyone for your support, and a special shout out to the team at the KG Firm!
